These Terms of Use (“Terms”) are a legal agreement between you and HOW G.P. governing your use of the Kiddoz app and website. Please read them carefully. By creating an account or using Kiddoz, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use Kiddoz.
1. Who we are
Kiddoz (“Kiddoz”, “we”, “us”) is operated by HOW G.P., a company established in Greece. You can reach us at dimitris@howstudio.dev.
2. Eligibility
You must be at least 18 years old and able to form a binding contract to use Kiddoz. Kiddoz is intended for parents and guardians. You are responsible for all activity under your account and for any use of Kiddoz by members of your household.
3. Your account
You are responsible for keeping your login credentials secure and for the accuracy of the information you provide. You may invite other adults to share your family; anyone you add can access and manage the shared family. Notify us promptly of any unauthorized use.
4. The service
Kiddoz suggests real-world, screen-free activities to do with your child, selected or generated to match the age and interests you provide, and can remind you on a schedule you choose. Activity suggestions are provided for your convenience and inspiration.
5. Free activities and subscriptions
Each family can receive a limited number of activities for free (currently the first three). To continue receiving new activities beyond the free allowance, you need a Kiddoz Pro subscription. Kiddoz Pro is offered as an auto-renewable subscription, available as a monthly or annual plan. The current price is shown in the app in your local currency before you purchase.
- Payment is charged to your Apple ID account upon confirmation of purchase.
- Your subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period.
- Your account is charged for renewal within 24 hours before the end of the current period, at the price of the plan you selected.
- You can manage or cancel your subscription, and turn off auto-renewal, in your device's App Store account settings after purchase (Settings → your name → Subscriptions).
- Canceling stops future renewals; your subscription remains active until the end of the current billing period. Partial periods are not refunded except where required by law.
- Any unused portion of a free allowance is forfeited when you purchase a subscription.
We may change subscription prices or plans. If a change affects your renewal, we will give notice as required, and you may cancel before it takes effect. Refunds for App Store purchases are handled by Apple in accordance with Apple's policies; contact Apple Support for refund requests. These terms are in addition to any App Store terms that apply to your purchase.
6. Safety — please read
Kiddoz suggests activities that may involve physical play, movement, household items, craft materials, food, or the outdoors. You are solely responsible for the safety of your child.
Before and during any activity you must use your own judgment to assess whether it is appropriate for your child's age, abilities, health, and environment; check for hazards such as choking risks, allergies, sharp or hot objects, and unsafe surroundings; and supervise your child at all times. Skip or adapt anything that is not safe for your child. Kiddoz is not a substitute for parental supervision and judgment.
7. AI-generated content
Some activity content is created using artificial intelligence and is provided “as is”. It may occasionally be inaccurate, incomplete, or unsuitable for your particular child or situation. You are responsible for reviewing each suggestion before acting on it. Read Section 6 (Safety) together with this section.
8. Acceptable use
You agree not to: misuse or interfere with the service; attempt to access it in unauthorized ways; reverse engineer, scrape, or copy it except as permitted by law; resell or commercially exploit it; or use it to violate any law or the rights of others.
9. Intellectual property
Kiddoz, including its software, design, and content, is owned by HOW G.P. or its licensors and is protected by intellectual property laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use Kiddoz for your own family's non-commercial use, subject to these Terms.
10. Disclaimers
To the maximum extent permitted by law, Kiddoz is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or that content will suit your needs. Nothing in these Terms limits rights you have as a consumer that cannot be limited by law.
11. Limitation of liability
To the maximum extent permitted by law, HOW G.P. and its partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from your or your child's participation in any activity. Our total liability for any claim relating to the service is limited to the amount you paid us for the service in the 12 months before the claim (or, if you paid nothing, to €50). Some jurisdictions do not allow certain limitations, so some of these may not apply to you, and your mandatory consumer rights are unaffected.
12. Indemnification
You agree to indemnify and hold HOW G.P. harmless from claims and expenses arising out of your misuse of Kiddoz or your breach of these Terms, to the extent permitted by law.
13. Termination
You may stop using Kiddoz and delete your account at any time in the app. We may suspend or terminate your access if you breach these Terms or to protect the service or other users. Sections that by their nature should survive termination (such as intellectual property, disclaimers, and limitation of liability) will survive.
14. Apple App Store terms
The following applies to the extent you obtained Kiddoz through the Apple App Store:
- These Terms are between you and HOW G.P. only, and not with Apple. Apple is not responsible for Kiddoz or its content.
- Your license to use Kiddoz is limited to use on any Apple-branded device that you own or control, as permitted by the App Store Terms of Service.
- Maintenance and support for Kiddoz is our responsibility, not Apple's. Apple has no obligation to provide support.
- To the extent any warranty applies and Kiddoz fails to conform to it, you may notify Apple, and Apple may refund the purchase price (if any) paid for the app; otherwise Apple has no other warranty obligation.
- Apple is not responsible for addressing any claims relating to Kiddoz, including product-liability, legal or regulatory, or intellectual-property claims.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
15. Governing law
These Terms are governed by the laws of Greece, without regard to its conflict-of-laws rules. The competent courts of Greece will have jurisdiction over any dispute, except that if you are a consumer resident in the European Union, you also benefit from any mandatory protections and may bring proceedings in the courts of your country of residence.
16. Changes to these Terms
We may update these Terms from time to time. We will change the “Last updated” date above and, for material changes, provide additional notice where appropriate. Continued use of Kiddoz after changes take effect means you accept the updated Terms.
